1. Acceptance of Terms

By accessing or using Makinika, you agree to be bound by these Terms of Service. If you do not agree, you may not use the platform. These terms apply to all users, including students, parents, guardians, teachers, and administrators.

2. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Learners under the applicable age of digital consent must have their account created or supervised by a parent, guardian, or teacher.

3. Acceptable Use

You agree not to:

• Use Makinika for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorized access to any part of the platform or other users' accounts.
• Upload or distribute malicious software, spam, or content that infringes on others' rights.
• Interfere with or disrupt the platform's servers, networks, or security features.
• Impersonate another person or misrepresent your affiliation with any individual or organization.
• Cheat, exploit bugs, or manipulate leaderboards, achievements, or mCoin systems unfairly.

4. Content and Intellectual Property

All content on Makinika — including quizzes, questions, explanations, artwork, code, and branding — is the property of Makinika Learning Co. or its licensors. You may not copy, modify, distribute, or create derivative works without explicit permission.

5. mCoins, Payments, and Purchases

Makinika may offer virtual coins, subscriptions, or other paid features. All purchases are final and non-refundable unless required by law. Payment features are restricted to adult-linked accounts. Learners may not make purchases directly.

6. Termination

We reserve the right to suspend or terminate your account at any time for violations of these terms, fraudulent activity, or behavior that harms the community. You may also delete your account at any time through your profile settings.

7. Disclaimer of Warranties

Makinika is provided "as is" without warranties of any kind. While we strive for accuracy, we do not guarantee that educational content is error-free or that the platform will always be available or secure.

8. Limitation of Liability

To the fullest extent permitted by law, Makinika Learning Co. shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform.

9. Governing Law

These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.
